By accessing or using DayPlay (the Service), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time, and continued use after changes take effect constitutes acceptance of the updated terms.
2. Description of Service
DayPlay is a discovery-first city planning platform that helps culturally curious people find, save, and transform ideas into plans. Our Service includes browsing cultural signals, saving venues and events, building itineraries, and sharing plans with others. DayPlay is currently in pre-launch and offered on an invitation-only basis through our waitlist.
3. User Accounts & Responsibilities
To access certain features, you may need to create an account. You agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately at info@dayplay.io of any unauthorized use.
4. Acceptable Use
You agree to use DayPlay only for lawful purposes and in a way that does not infringe the rights of others. Prohibited conduct includes:
- Using the Service for any illegal activity or to harass, abuse, or harm others
- Attempting to scrape, crawl, or reverse-engineer the platform
- Uploading malware, spam, or other harmful content
- Impersonating any person or entity
- Interfering with the security or operation of the Service
5. User-Generated Content
DayPlay may allow you to submit, post, or share content such as reviews, comments, tips, or plan notes. You retain ownership of your content, but you grant DayPlay a non-exclusive, royalty-free, worldwide license to use, display, and share that content within the Service. You represent that your content does not violate any third-party rights.
6. Intellectual Property
The DayPlay name, logo, brand assets, design, code, and all original features of the Service are owned by DayPlay and protected by copyright, trademark, and other intellectual property laws. Nothing in these terms grants you a license to use our trademarks or branding without prior written consent.
7. Disclaimer of Warranties
DayPlay is provided as-is and on an as-available basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure. City information and cultural signals are curated from publicly available sources and may not always be accurate or up to date.
8. Limitation of Liability
To the fullest extent permitted by law, DayPlay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these terms shall not exceed the amount you have paid us, if any, in the preceding twelve months.
9. Indemnification
You agree to indemnify and hold harmless DayPlay, its affiliates, and their respective officers, directors, and employees from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.
10. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions regarding intellectual property, disclaimers, liability limitation, and indemnification shall survive termination.
11. Governing Law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

We may revise these Terms of Service at any time by posting the updated version on this page. Material changes will be communicated via email or through the Service. Your continued use after changes take effect constitutes your acceptance of the new terms.
